Former trooper indicted on sexual abuse charge

SELMA — On Dec. 29, 2006 The Selma Times-Journal ran a story praising Troopers Steven James and Kerry Horton.
James and Horton delivered a baby on the side of the road.
As of Oct. 29, Horton is no longer an Alabama State Trooper and was just indicted of sexual abuse first-degree by a Perry County Grand Jury.
“Kerry Horton was indicted [Thursday] from a 2008 incident,” said District Attorney Michael Jackson. “He will be arraigned in circuit court in the next few months.”
Horton was fired following the reported misconduct.
On March 28, 2008, Horton pulled over a vehicle for a possible driving under the influence arrest.
After running the driver’s information through the National Criminal Intelligence Service, Horton noted he had a previous drug possession charge.
Horton stated he asked the driver if he could search the car and the driver complied.
The stories of the trooper and victim start to differ at this point.
A deputy, who was called to help with the search, took the driver into custody once marijuana was found in the vehicle. The passenger in the car, the victim, was left with Horton, which both sides agree to this point.
Next Horton says the female came onto him and began removing her clothing. The female states the trooper fondled her without her consent.
The grand jury found enough evidence to suffice charging the trooper with sexual abuse first-degree. Horton still is innocent until proven guilty by a court of law.
The Code of Alabama defines sexual abuse in the first degree as when a person “subjects another person to sexual contact by forcible compulsion.” It is a class-c felony.
Horton was arrested and placed in the Perry County Jail under a $20,000 bond.

It looks like the troopers would have developed a protocol for this situation that would have better protected the suspect and the trooper. It looks like both troopers could have stayed there until a female trooper arrived to assist. What do you think Toad? popdukes12

Toad doesn't know what to say other than he is glad that a bad trooper is off of the streets.
Toad is sure, however, that Cpl. Hubbard doesn't want to be called out every time a trooper is dealing with a female. This would be especially true after a long day on the river.

I beleive so, but she is still the only female trooper that I am aware of in this area.

They need to start posting pictures of these people committing these kind of behaviors so everyone will know what they look like incase they run across them.

Toad and tbrb, you seem pretty quick to brand Horton as a "bad trooper," when so far all there is is an indictment. You're smart enough to know that doesn't equate to a guilty verdict. And I'm sure you've read before of trials involving officers who were not convicted at trial after an indictment was handed down based on false accusation. We don't know what evidence, or lack thereof, the grand jury had at hand for them to pass on the indictment. Cpl. Hubbard can't be at every scene where a lone male trooper pulls over a lone female driver. The dash cam is supposed to be the impartial witness. If the events here occurred out of range of the dash cam (and I have no idea whether they did or not), then so far all we know for sure is that the trooper exercised poor judgment in moving out of camera range. Meanwhile, the trooper is off the street; on one hand protecting citizens if he is guilty, and on the other protecting him if he is innocent.

Dogbert, Not knowing the situation of how Tpr. Horton's car was equipped, but, I think I am correct in stating that some cars of the state troopers are not equipped with dash cams. Someone else may have better information on this.

Not knowing all the facts of this story, so it's hard to may an assumption, but i know trHorton. He always carried himself to be a firm trooper, so it's hard to believe that he would jeopardize his career and marriage like that. I hope that justice does the right thing either way.

i think everyone making comments on this case needs to know more about the case than what ur reading online and in newspapers...Kerry Horton is not only a friend of mine for the past 13 years but a member of my family. kerry horton is a great man a hard worker and loves his family he has three beautiful daughters that looks up to him as their hero. maybe everything looks bad and noone wants to believe the "former trooper" but when he was a trooper he was praised for the good deeds he done and what a great man he is....now i will stand behind him and support him 100 percent until i am proved other wise and i dont think one person should make a comment about what is goin on when u r not involved.

Ok wait a minute, now this doesn't apply to some of you but then it does to others. Just a minute ago some of the bloggers on here were bashing the hell out of the police officer who's alleged rape case was no billed by the same grand jury who true billed this trooper. Where in the hell is WellSTJ and some of the other hang'em high rebel rousers. I really believe SOME folks who post on here have an agenda with the police department. If this had been a police officer who had been indicted for the same charge we'd already be looking for a jail cell to put him in. I agree that this is only an indictment and not a conviction but this case was handled by the same grand jury that handled the police officers case and we are just now learning his (trooper) name. WellSTJ and some of you others, now is all we need if for a Dallas Co. deputy to have an allegation against them and you will be scared of all law enforcement in Dallas Co.

Wedgie, you probably will not hear from the bashers in this case. I know many of our troopers around the state, and alot of our local SPD and deputies, as well as some of our State Game Wardens and I feel as though they are all upstanding men and women. This case is most likely a bunch of bull that never even happened. As I said" he said, she said". The problem is the bleeding hearts of this counrty that cannot tell fact from fiction. And that is what has ruined not only this mans' life and career but many others, such as the before metioned SPD officer. We are in a sad state of affairs when a law officers word is not taken for even an ounce of truth. GOD help this great state and great country.

I agree with bethbaswell and scruffy...it is truly unfair that people begin to label a person for what they are accused of doing. As this article states, this same trooper was praised for helping to deliver a baby on the side of the road and all of that praise goes out the window the minute some woman hollers foul! This city, state, and country are in a sad state when people are so judgemental. I also know this trooper and his family and am certainly dumbfounded by the accusations being made against him as there is certainly more to this than what this accuser wants anyone to know.

In many cases such as this, as the article stated, the accused did nothing but turn the person down,i.e.---
"Next Horton says the female came onto him and began removing her clothing."
And since that did not work, scream that you have been touched in the wrong way and get the trooper in major trouble.
The trooper should never had been fired, just put behind a desk until this could be cleared up. Now we have lost a great trooper, who was trying to get crime off the streets.

thankyou to scruffy and mrines: kerry is a very good man and absolutly loved everytime he put on that uniform to go to work to help protect the citizens in this state, i believe that the state troopers not only lost a great officer but they lost respect for alot of ppl that knows kerry horton an the man he is. not only did kerry graduate trooper academy at the top of the class but was working at becoming an investigater. kerry has protected the city of selma for years prior as a honored firefighter. i thank everyone that has kept this family in your prayers and hope u keep doing so.

Just one more thought, HOW could the grand jury have done something this stupid? Lets look a few of the facts---
1) You have a Trooper that has been praised for many things
2) An honored firefighter
3) An upstanding husband and father.
And then you have a female that is riding around with a pot head that has just gotten pulled over for DUI.
Seems like the grand jury dropped the ball on this one.
My prayers will be with Kerry Horton and his family during this trying time. When found innocent, he should be re-instated with all back pay and a public apology from the so called "justice system" and the female.
