The indictment and charges stem from an incident on Jan. 15, 2011 outside the 12 Tropicana on Alabama Avenue.
According to accounts, the suspect — believed to be Fitts — opened fire outside the club, striking five people, killing one. The one victim who was killed, Rodney Martin, was struck by a bullet in the upper torso.
The other victims suffered gunshot wounds to hips, knees, arms and thighs.
Selma Chief of Police William T. Riley said in an interview the day after the shooting, that officers responded to the scene where they saw Fitts and ordered him to halt. Instead of stopping, Riley said Fitts turned and pointed his gun in the direction of the officers.
“Officers then fired several rounds,” Riley said. “The suspect then turned and ran from the scene while officers attended to the victims.”
Fitts then fled the state, and was later captured by authorities in Henricho County, Va.
