As the officer approached Moss, he smelled a strong odor of marijuana coming from inside the vehicle.  Officer asked Moss if he had illegal drugs inside the vehicle.  Moss reached into his left pocket and pulled out a small quantity of marijuana, giving it to the officer.

The officer asked Moss if he had any weapons inside the vehicle.  Moss said there was a gun and he did not have a permit for it.  The officer asked Moss to exit the vehicle and he did.  Moss told the officer that the firearm was in his front right pocket.  The firearm is described as a Smith & Wesson, .38 caliber revolver.  The officer arrested Moss.

At the time of the arrest, Moss had been convicted of at least three felonies: Resistance to Official Search (April 16, 2010), in the U.S. District Court for the Southern District of Alabama, Unlawful Possession of a Controlled Substance, attempt – Trafficking Cocaine (May 18, 2010) in the Dallas County Circuit Court.

The SPD and special agents of the ATF investigated the case, then brought it to U. S. Attorney’s Office for prosecution. Assistant U.S. Attorney Gina S. Vann is assigned to the case.
