Authorities say no charges will be filed against the businessman who was shot and returned fire killing an attempted robber last week.

A Selma Police Department spokesman said investigators had talked with attorney Bruce Maddox, who was consulted by Nathaniel Gary, owner of Doc’s Fashions. Gary was shot in the leg

on the night of Feb. 17 after he closed and was attempting to leave his 1522 Broad St. clothing store.

Maddox said Friday he “could not comment at the moment” on the legal status of his client, but confirmed they had been in touch with police.

When Gary was accosted he returned fire, fatally wounding Michael Walker, 18, who was pronounced dead at the scene, according to police. A second alleged robber, Keotha Billingsley, 17, was arrested shortly after the incident. Billingsley was released on $5,000 bail and charged with robbery. Police said the charges may be upgraded and Billingsley will be charged as an adult.

Police were called to the scene just after 7:30 p.m., where officers found Walker on the ground in an alley where Gary was reportedly about to get into his vehicle. A 9-mm Highpoint was found lying beside Walker.

“Gunshots were exchanged, and Mr. Gary was shot in the upper left thigh,” said Det. Frederick Walker. “Mr. Walker was shot in the upper right side.”

Police recovered seven shell casings from the scene, and received information on the whereabouts of Billingsley, the second suspect, in the foiled robbery. Police said Walker and Billingsley both “have extensive criminal records.”

Gary was transported to Vaughan Regional Medical Center where he was treated and released, police said.

Gary was recuperating, Maddox said.

“He had more damage from the gunshot than we realized,” Maddox said. “There is a broken bone, and it may require surgery.”
